وقتی گنجی باینری فکر می‌کند!

اکبر گنجی دیروز در میان ایرانیان تورنتو گیر سه پیچ خود را به تک تک جملات قانون اساسی تشریح کرد. وی ضمن بررسی تناقض موجود در تبصره‌ی دال بند ۷۸ قانون اساسی ثابت کرد که رژیم ایران اصلاح ناپذیر است. اکبر گنجی در جواب این سوال که خب حالا چی کار کنیم گفت که یک‌شنبه‌ی هفته‌ی آینده در ساعت ۳ بعدازظهر مفصل راه گذار ایران به دموکراسی را توضیح خواهد داد.

گنجی طی سخنان مبسوطی و با اشاره به جملات قانون اساسی (من: نه که حالا تو کشور ما خیلی قانون اجرا میشه!) نشان داد که در ایران انتخابات آزاد برگزار نمی‌شود و تازه اگر فرض محال هم بشود آن وقت انتخاب شونده هیچ کاری نمی‌تواند بکند. در جواب سوال من و یک دوست عزیز دیگر که ساختار حقوقی قانون اساسی مهم نیست و این ساختار حقیقی است که مهم است گفت که نخیر! وقتی بنده گفتم که در خود کانادا هم خیلی از مشکلاتی که ایشان از ساختار حقوقی قانون اساسی برشمردند وجود دارند (سنای کانادا با اعضای مادام‌العمر مانند شورای نگهبان حق لغو قوانین پارلمان را دارد یا فرماندار کل می‌تواند حکم نخست‌وزیر کانادا را عین همین ولایت‌فقیه خودمان تنفیذ نکند) گنجی گفت که خب قانون کانادا هم پس قانون خوبی نیست!

وا... بنده‌ی حقیر که عمری است ریاضی و فیزیک خواندم به این قطعیتی که گنجی در مسایل اجتماعی اظهار نظر می‌کند درباره‌ی علوم طبیعی حرف نمی‌زنم. گنجی یه طوری حرف می‌زند که مثلا یا انتخابات آزاد است یا نیست!! چه می‌دانم یا نظام اصلاح‌پذیر است یا نیست. این تفکر باینری را گنجی از کجا پیدا کرده خدا می‌داند!

اقا گنجی فکر میکنه هنوز سیطره تاریخی شاهنشاهی انهم وابسته
و دیکتاتور ی پهلویهاست و قشر وسیعی از مردم کوچه و بازار
و روشنفکران چپ و راست رو در روی ان و دولت نخودس و بیخودی هویدا
و متاسفانه دنبال داش اکل شدن و لوطی صالح شدنست ....بیدارش کنید
در زندان انفرادی عوضش کردند !!؟

Dear Yaser

Please note that the governer general
of canada is selected by the prime minister of canada. She can obviously
withold her endorsement of the election results but she does not have the means to withstand the consequences. She can not restrict the protest of civil society to such actions. She does not have any particular authority on the armed forces, and so on and so forth.

And about the Canadian senate, the members are selected by the prime minister of Canada.

You seem to agree with Mr. Hajarian that the Queen of England enjoys the same authrorities and rights as the iranian leader but she refrains to use those just because of the social realities of British society. This assumption is incorrect. The Queen's authorities are limited by Magna Carta which was passed about 800 years ago. We do not an equivalent of Magna Carta in our political system.

Please note that there are checks and balances in the poltical system of western democracies. There are no such mechanisms in the Iranian political system.

As far as I know, Magna Carta was introduced mainly to limit the power of queen or king in treatment of church officials and nobles.
Almost all clauses of that law are repealed. Only clause 1, 13, 29 are still in effect. None of them are as limiting as Anonymous claims. For example, Clause 1 deals with church officials, Clause 13 is about some ancient liberties in London.

Therefore, in theory, the queen (or king) is the absolute power in the UK. But, in practice, s/he cannot use her power, because of social/political realities of British society.

Compared to Magna Carta, the current Iranian constitution is much more limiting, although it is a real mess and full of flaws.
It is the political/social/economical realities of Iran that allows for abuse of power.
